Please read these terms carefully before using our services.

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website itcares.ca and all services provided by IT Cares ("we," "us," or "our"), a Canadian company offering remote and on-site IT support services across Canada. By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

2. Services

IT Cares provides professional remote and on-site IT support services, including but not limited to:

  • Remote computer diagnostics and repair via AnyDesk
  • Virus and malware removal
  • Software installation, configuration, and troubleshooting
  • Data backup, recovery, and migration
  • Network setup and cybersecurity consulting
  • Website design and digital marketing for businesses
  • PC and Mac hardware diagnostics

Services are delivered remotely via AnyDesk secure remote access software, or in-person where available. All services are performed by trained IT professionals. We reserve the right to decline any service request at our discretion.

3. Pricing & Payment

IT Cares operates on a transparent flat-rate pricing model. Prices are clearly listed on our website and confirmed before any service begins. Our standard rates include:

  • Full Repair Session: $99 flat rate — covers most PC/Mac issues in a single session
  • SOS Emergency: Priority same-day service, rate confirmed at booking
  • Business Support: Custom packages, quoted in advance

Payment is due at the time of service, unless otherwise agreed in writing for business clients. We accept major credit cards and e-Transfer. All prices are in Canadian dollars (CAD) and are subject to applicable taxes (GST/QST where applicable).

Refund Policy: We offer a 100% money-back guarantee if your issue is not resolved during the session. No questions asked. Refunds are processed within 3 to 5 business days to your original payment method.

4. Remote Access

For remote support sessions, you will be asked to download and run AnyDesk, a trusted and encrypted remote desktop application. By initiating a remote session, you:

  • Authorize IT Cares technicians to access and control your computer solely for the purpose of resolving your reported issue
  • Confirm that you are the owner of the device or have authorization from the owner
  • Understand that you may revoke access at any time by closing the AnyDesk application or pressing the Disconnect button

Security Commitment: IT Cares technicians will never ask for your passwords verbally or in writing. All AnyDesk sessions use end-to-end encryption. We do not retain remote access to your device after the session ends. You are always in control.

5. Service Guarantee

IT Cares stands behind its work with a straightforward "Fixed or Refunded" guarantee, specifically applicable to the $99 Full Repair Session:

  • If your reported issue is not fully resolved during the session, you owe nothing and will receive a full refund if payment was already collected
  • The guarantee applies to the specific issue reported at the time of booking
  • Issues that arise from hardware failure, manufacturer defects, or causes outside the scope of software-based support may not qualify for the guarantee but will be clearly communicated before any charges are applied

6. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, IT Cares' total liability to you for any claim arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

IT Cares is not liable for:

  • Loss of data, revenue, or profits arising from service delivery
  • Damage caused by pre-existing hardware or software conditions
  • Indirect, incidental, or consequential damages of any kind
  • Third-party software or service failures (e.g., Microsoft, Apple, Google)

We strongly recommend that clients maintain current backups of all important data before any IT service is performed. IT Cares is not responsible for data loss resulting from pre-existing conditions.

7. Data & Privacy

IT Cares is committed to protecting your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25).

The collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By using our services, you consent to the data practices described in that policy.

8. Cancellation Policy

We understand that schedules change. Our cancellation policy is as follows:

  • Free cancellation: Cancel or reschedule at no charge up to 24 hours before your scheduled appointment
  • Late cancellation fee: A $25 CAD fee applies for cancellations made less than 24 hours before the scheduled session
  • No-show: If you are unavailable at the scheduled time without prior notice, the session may be billed in full

9. Intellectual Property

All content on itcares.ca, including but not limited to the IT Cares name, logo, text, graphics, and software, is the exclusive property of IT Cares and is protected by Canadian intellectual property law.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent. Unauthorized use of IT Cares trademarks or branding is strictly prohibited.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, Canada.

If you are a consumer, you may also have rights under applicable provincial consumer protection legislation, including Quebec's Consumer Protection Act (CPA), which may take precedence over these Terms where applicable.

11. Changes to These Terms

IT Cares reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
